The U.S. Department of Homeland Security is the agency that houses U.S. Citizenship and Immigration Services, U.S. Immigration and Customs Enforcement, and U.S. Customs and Border Protection, among other divisions. Employers will need to familiarize themselves with the Immigration and Customs Enforcement, which oversees the Form I-9 requirements.
U.S. Citizenship and Immigration Services (USCIS)
Federal law requires that every employer who recruits, refers for a fee, or hires an individual for employment in the United States must complete Form I-9, Employment Eligibility Verification. USCIS has put Form I-9 requirements at I-9 Central.
U.S. Immigration and Customs Enforcement (ICE)
Employers may also have some interaction with ICE, most likely through audits of their Form I-9s. If I-9s are not completed in compliance with federal law, employers may incur penalties.
